What is an Uncontested Divorce?
​An uncontested divorce is a streamlined legal process for couples who agree that it is time to end their marriage and can agree on the terms. The most significant advantage? There is absolutely no court appearance required. When you file for an uncontested divorce, a judgment is typically obtained by default. We handle the paperwork, court filings, and certification, allowing you to finalize your divorce without ever stepping foot in a courtroom.

Do I Qualify for a Quick Uncontested Divorce?
To qualify for this efficient process in Louisiana, your situation must generally meet the following criteria:

Required Separation: You and your spouse must have lived separate and apart for the time period required by Louisiana law (6 months if there are no children born of the marriage; 12 months if you share children).

Mutual Agreement: Your spouse must be willing to sign a simple, one-page affidavit (waiver) in front of a notary.

No Covenant Marriage: Your marriage must be a standard marriage, not a covenant marriage.

No Active Military: Neither spouse can currently be deployed in active military service.

No Pending Adoptions: There must be no ongoing adoption proceedings.

The "No Court" Process: How It Works
If you meet the qualifications, our attorneys will handle the heavy lifting:

Drafting the Documents: We prepare all necessary legal petitions and the one-page waiver for your spouse.

The Affidavit: Your spouse simply signs the waiver in front of a notary and returns it to our office. This waiver acknowledges receipt of the petition, waives formal service by a sheriff, and confirms they do not wish to appear in court.

Filing & Finalizing: We submit the finalized paperwork directly to the Judge’s courtroom for signature.
Because both parties are in agreement and the waiver is signed, the judge can grant the divorce by default. It is a highly cost-effective, private, and efficient way to handle your separation.
